Contract Between Fan and Creator

This Contract sets out the terms that apply to interactions between a Fan and a Creator on ClapCall. It covers free subscriptions, private messaging, paid calls, and gifts. It is formed automatically when a Fan subscribes or initiates any transaction. ClapCall is not a party to this Contract — ClapCall processes payments and provides the platform infrastructure but is not responsible for the obligations of either party.

1. Free Subscriptions

• Subscribing to a Creator is always free. There are no paid subscription tiers.
• When you subscribe, you gain the ability to send private messages to that Creator.
• Subscriptions never expire — they continue until you unsubscribe or one party's account is closed.
• The Creator can see who subscribes to their profile.

2. Private Messaging

Fans who subscribe to a Creator may send private messages for free. Both parties must communicate lawfully and respectfully. Neither party may use messages to:

• Harass, threaten, or abuse the other party.
• Arrange any payment or service outside the ClapCall platform.
• Solicit any illegal activity.

All private messages are end-to-end encrypted. Neither party may share message content with any third party without the other's consent.

3. Calls

Billing

Creators set their own per-minute call rate ($0.01–$199.00/min). Charges are deducted from the Fan's wallet in real time based on actual connected seconds. If the wallet reaches zero, the call ends automatically — the Fan is only charged for time actually connected. Either party can end the call at any time.

Conduct

Both Fans and Creators must behave respectfully. Creators must engage in good faith for the duration of the call. Fans must not solicit illegal activity or attempt to record the call.

Recording prohibited

Recording calls — by either party, by any means — is strictly prohibited. Violation results in immediate account termination.

Failed calls

If a call fails due to a verified technical fault on ClapCall's end, the Fan can request a refund by contacting support@clapcall.com within 48 hours.

4. Gifts

• Gifts are entirely voluntary and are not made in exchange for any content, call, or service.
• Fans choose any custom gift amount.
• Gifts are non-refundable once sent.
• A Creator has no obligation to acknowledge or provide anything in return.
• Sending a gift does not create any obligation or entitlement between the Fan and the Creator.

5. Fan Responsibilities

• Treat Creators with respect and courtesy at all times.
• Do not attempt to arrange any payment or service outside ClapCall.
• Do not harass, threaten, or stalk Creators through any platform feature.
• Do not submit false complaints or reverse gift payments in bad faith.
• Do not record calls or share private messages without the other party's consent.

6. Creator Responsibilities

• Ensure your profile accurately represents who you are and what you offer.
• Own or have the rights to all content you publish.
• Ensure every person depicted in your content has given documented consent.
• Do not mislead Fans about the nature of your content or services.
• Do not solicit or accept payments from Fans outside the platform.
• Engage in good faith during calls and communicate respectfully with Fans.

7. Disputes and Refunds

Call charges and gifts are non-refundable except where a call fails due to a verified technical fault on ClapCall's end. If a Fan and Creator cannot resolve a dispute directly, either party may escalate to ClapCall through our Complaints Policy. ClapCall's decision is final within the platform process. Fans agree to contact ClapCall before initiating a chargeback.

8. Blocking and Account Closure

Creators can block any Fan at any time without notice. If a Creator closes their account, all subscriber relationships end and no refund is due as subscriptions are free.

9. Governing Law

This Contract is governed by the laws of Wyoming, United States. Disputes are subject to the arbitration provisions in ClapCall's Terms of Service. EU and UK users retain their statutory consumer rights.
