DMCA Copyright Policy

ClapCall respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). This Policy explains how to submit a copyright infringement notice, how to respond to one, and how we handle repeat infringers.

2. Submitting a Takedown Notice

Send a written notice to dmca@clapcall.com. To be valid under 17 U.S.C. § 512(c)(3), your notice must include:

  • Your name, address, phone number, and email address.
  • A description of the copyrighted work you claim has been infringed.
  • The specific URL(s) on ClapCall where the infringing content appears.
  • A statement that you have a good faith belief the use is not authorised.
  • A statement, under penalty of perjury, that the information is accurate and you are authorised to act.
  • Your physical or electronic signature (typing your full legal name counts).

3. What Happens Next

  • Acknowledge receipt within 2 business days.
  • Remove or disable access to the identified content within 5 business days.
  • Notify the Creator and explain the counter-notification process.
  • Forward a copy of the notice to the Creator. By submitting a notice, you consent to this.

4. Counter-Notification

If your content was removed and you believe this was a mistake, submit a counter-notification to dmca@clapcall.com. A valid counter-notification must include:

  • Your name, address, phone number, and email address.
  • A description of the removed content and the URL where it appeared.
  • A statement, under penalty of perjury, that you believe the removal was a mistake.
  • A statement consenting to the jurisdiction of the Federal District Court for your district.
  • Your physical or electronic signature.

We will restore content within 10–14 business days unless the claimant notifies us they have sought a court order.

5. Repeat Infringers

  • 1st valid notice: Content removed, Creator warned.
  • 2nd valid notice within 12 months: Content removed, account suspended.
  • 3rd valid notice, or 2nd following a prior suspension: Account permanently terminated.

6. Misuse

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that content is infringing may be liable for damages, costs, and legal fees.
